US Judge Mandates Release of Abrego Garcia from ICE Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal proceedings involve disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
